Family Violence
Careful, confidential support when safety and rights matter.
Family violence matters are deeply personal and often urgent. If you are experiencing family violence, or have been accused of it, it is important to receive clear advice and support as early as possible.
At Spero Law, we approach family violence matters with care, discretion, and respect. Our focus is on helping you understand your options, protecting your safety and rights, and guiding you through what can be an overwhelming process.
A steady and respectful approach
Family violence can take many forms. It is not limited to physical harm and can include emotional abuse, coercive behaviour, threats, financial control, or behaviour that causes fear or distress.
We understand that people come to us in very different circumstances. Some clients are seeking protection. Others are responding to allegations. In every case, we take the time to listen, explain the process clearly, and act with sensitivity.
Family Violence Intervention Orders (FVIOs)
Family Violence Intervention Orders are court orders designed to protect individuals from family violence. In Victoria, these matters are generally dealt with in the Magistrates’ Court.
FVIOs can place significant restrictions on a person’s behaviour and can have lasting consequences, including impacts on family law matters, employment, and future court proceedings.
Who can apply
Applications for an FVIO can be made by:
- the affected family member
- police, on behalf of the affected family member
- another person with the permission of the court
Orders can protect current or former partners, children, relatives, and people in family-like relationships.
Types of orders
Interim orders
Interim orders provide short-term protection while the matter is before the court. These orders are often made urgently and can be issued without the other party being present.
Final orders
Final orders are made after the court has considered the evidence and submissions. They typically last for a fixed period but can be extended or varied if circumstances change.
What behaviour can be restricted
Family violence orders can restrict a wide range of behaviour, including:
- physical violence
- emotional or psychological abuse
- threats or intimidation
- coercive or controlling conduct
- financial or economic abuse
Common conditions may prohibit a person from contacting the protected person, approaching them, or attending certain locations such as a home, workplace, or school.
Breaching an FVIO is a criminal offence.
How we can assist
We can assist clients who are:
- seeking protection through an FVIO
- responding to an FVIO application
- negotiating consent orders where appropriate
- preparing for contested hearings
- seeking variations or revocation of existing orders
We also provide advice on evidence, court process, and the practical implications of orders, including how they interact with parenting arrangements and other family law matters.
Children and family violence matters
When children are involved, the court places a strong emphasis on their safety and best interests.
We assist clients to understand how family violence orders may affect parenting arrangements, time with children, and related family law proceedings. Where appropriate, we help ensure that orders are structured in a way that protects children while remaining workable.
Support, confidentiality, and fees
We understand that cost can be a barrier for people experiencing family violence.
Spero Law offers fee reductions for clients impacted by family violence, and we are committed to treating these matters with confidentiality and discretion. Where appropriate, we can also assist in connecting you with external support services.
